When you use our service, you agree to be solely responsible for the payment of all of Our Services and you release Nikatomi Capital LLC, its officers, directors, agents, volunteers, and employees of and from any and all responsibility for, or claims, damages, debts, arising out of Our Service.
Nikatomi Capital LLC reserves the right to immediately change or stop its service if we believe it is necessary to protect our interests or the interests of our staff.
Subject to the terms and conditions of this Agreement, Nikatomi Capital LLC shall attempt to provide Hosting for twenty-four (24) hours a day, seven (7) days a week throughout the term of our Agreement. The Customer agrees that from time to time the Hosting service may be inaccessible or inoperable for any reason, including, without limitation: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs which Nikatomi Capital LLC or its supplier may undertake from time to time; or (iii) causes beyond the control of Nikatomi Capital LLC or its suppliers which are not reasonably foreseeable by Nikatomi Capital LLC, including, without limitation, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network congestion or other failures. The Customer agrees that Nikatomi Capital LLC has no control of availability of Hosting on a continuous or uninterrupted basis.
If you instruct us to create a website for you and do not provide any or only partial content, we may use external data such as text, images, videos, etc. from the Internet to create your website. We try to ensure that all rights and copyrights are observed. However, the websites we create with those data have only the character of a sample page and are not intended or suitable for routine operation. Nikatomi Capital LLC does not accept any liability. You should replace the content of your website as soon as it goes online.
You are not allowed to use our servers in any manner which infringes any law or regulation or which infringes the rights of any third party, nor will you authorise or permit any other person to do so.
You shall keep secure any identification, password and other confidential information relating to your account and shall notify us immediately of any known or suspected unauthorised use of your account or breach of security, including but not limited to loss, theft or unauthorised disclosure of your password or other security information.
You are solely responsible for providing, updating, uploading and maintaining your website or server and any and all files, pages, data, works, information and/or materials on, within, displayed, linked or transmitted to, from or through your website or server including, but not limited to, trade or service marks, images, photographs, illustrations, graphics, audio clips, video clips, email or other messages, meta tags, domain names, software and text.
You are solely responsible for undertaking measures to prevent any loss of data or damage to your website or server content. Our servers are not an archive and we shall have no liability to you or any other person for loss, damage or destruction of any of your content. We do not backup your data, you are solely responsible for backup your data!

You release, indemnify, and agree to hold Nikatomi Capital LLC harmless from any and all manner of damages, claims,loss, liabilities, costs or expenses, causes of actions or suits, whatsever in law or equity, (including, without limitation, attorney fees and related costs) arising out of or related to the services provided by Nikatomi Capital LLC, except which may arise from the sole gross negligence or intentional and willful misconduct of Nikatomi Capital LLC, including, without limitation, any inaccuracy in any statement made by yourself or information provided by you to Nikatomi Capital LLC, any action by yourself which is in breach of the terms and conditions of this agreement.
This agreement covers the current relationship between Nikatomi Capital LLC and yourself. Each time you use Our Service, you affirm the terms of this Agreement, and the truthfulness and accuracy of all statements you make in this Agreement.
